Preamble (non-alterable)
SwapYourVacationHome.com, referred to herein as "the Service," is a unique online community of travel enthusiasts. Please refer
to our contact
information. The Service enables a large, growing network of travelers to trade stays in their
vacation homes and other property.
The Service's owners, operators, employees, contractors, and other associates are referred to
herein as "the Operators."
A user of the Service, whether anonymous, registered, or a paying
subscriber, is referred to herein as "the User."
The User may create and manage property listings via the Service. The
properties to which these properties listings are associated are referred to
herein as the User's "Properties."
This document represents an agreement between one Host and one Guest
who engage in one "Stay" in one "Property." Either the Host or the Guest may modify
this document before it is signed.

- During the Stay, all drivers must be licensed and insured to operate motor

the operation of motor vehicles, wherever the vehicles are operated
- The driver (and if not the driver, the Guest) of one of the above vehicles
agrees to accept any and all financial responsibility for damage done to
said vehicle and other property, or personal injury, determined to be the
fault of said driver
- The Guest must inform the Host of any damage or personal injury done to or
caused by one of the above vehicles regardless of whether the driver of said
vehicle was determined to be at fault

Stay Fee
The total fee for the Stay is ____________, payable to in full to the Host by the
Guest prior to the arrival date, for cleaning and other
expenses. This fee is refundable in full if:
- The Host cancels the stay at any time for any reason
- The Guest cancels the stay within ____ (example: 30) or fewer
days prior to the arrival date
- The Host willfully misrepresents the above Property beyond an
"honest simple misunderstanding," which may require the determination of
a third party.
- The Host is responsible for inability of the above Property to
be occupied during any part of the above occupancy dates
Security Deposit
The security deposit required for the Stay is ____________, payable to in full to the
Host by the Guest prior to the arrival date. This fee is refundable in full
after the stay if the Property, its contents (inside and out), and surrounds are determined by the
Host to be undamaged and showing no signs of loss, theft, or
excessive wear that can be attributed to the Guest or the individuals
in the Guest's party.
Cancellation Penalty
Both the Host and Guest may incur expenses related to the Stay prior to or on the above arrival date. Therefore:
- If the Host cancels the stay within ____ (example: 30) or
fewer days prior to the arrival date for any reason, or if the Host is responsible for inability of the
Property to
be occupied during any part of the occupancy dates, or if the Host willfully misrepresents the property beyond an
"honest simple misunderstanding," which may require the determination of
